Acceptance of Terms
Welcome to VideoFrog ("we," "our," or "us"). By accessing or using our website and services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to any part of these Terms, you do not have permission to access the Service. Additionally, by using our paid services, you acknowledge and agree to the terms and conditions of our authorized payment processor and Merchant of Record, Creem Technologies Ltd. ("Creem"), including Creem's privacy policy (available at https://creem.com/privacy) and payment terms.
Description of Service
VideoFrog is an AI-powered video generation platform that allows users to create video content from text, images, and other inputs. We strive to provide high-quality services but do not guarantee that generated videos will always meet your exact expectations. Our paid services are processed and managed by Creem, which acts as the legal Merchant of Record (MoR) for all transactions, meaning Creem is the legal seller of record for all paid subscriptions and credit purchases made through our Service.
User Accounts
To access certain features, you may need to register for an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You must provide accurate and complete information. Your account information (including email address) will be shared with Creem solely for the purpose of processing payments, managing subscriptions, and complying with global tax and financial regulations. You agree to keep your account information up-to-date to ensure seamless payment processing and subscription management via Creem.
Usage Guidelines
You agree not to use the Service to:
- Generate any form of NSFW (Not Safe For Work) content, including but not limited to pornography, obscenity, sexual exposure, adult sexual activities, nudity, sexual suggestions, or suggestive content. This Service strictly prohibits generating AI-generated pornographic content or any form of sexually suggestive content, regardless of whether real persons are used.
- Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, pornographic, sexually explicit, or otherwise inappropriate for the workplace, including but not limited to nudity, adult sexual content, violence, or any form of discriminatory content.
- Infringe upon the intellectual property or other rights of any person or entity.
- Interfere with or disrupt the integrity or performance of the Service.
- Attempt to gain unauthorized access to the Service or its related systems or networks.
- Engage in any fraudulent activity, including but not limited to unauthorized use of payment cards, chargebacks without valid cause, or misuse of Creem's payment processing services.
Third-Party AI Model Provider Disclaimer
VideoFrog integrates multiple third-party AI video generation models, including but not limited to OpenAI Sora, Google Veo, and ByteDance Seedance. VideoFrog is not affiliated with, endorsed by, sponsored by, or otherwise connected to these third-party model providers. We act solely as a technology integration service provider and are not responsible for content generated by third-party models. This disclaimer does not apply to Creem, which is our authorized payment processor and MoR, and whose services are governed by Creem's own terms and privacy policy.
Intellectual Property
Subject to these Terms, you retain ownership of the content you upload to the platform. For video content generated using the platform, we grant you the right to use, reproduce, and distribute such content, provided you comply with these Terms. Creem retains no ownership rights to your content, but may process and store content-related data solely to fulfill its payment processing and fraud prevention obligations as our MoR.
Credits and Payments
Certain features of the Service require credits. Credits can be obtained through purchase or subscription. All payments for credits, subscriptions, or other paid services are processed by Creem, our authorized payment processor and Merchant of Record (MoR). By making a payment, you agree to Creem's payment terms, including its fees, currency conversion policies, and fraud prevention measures.
Subscription Terms
Subscriptions are recurring unless cancelled in accordance with these Terms and Creem's subscription management policies. We (via Creem) will charge your selected payment method on a recurring basis (monthly, annually, or as otherwise selected at checkout) until you cancel your subscription. In compliance with applicable regulations (including the upcoming April 10, 2026 implementation of the "Internet Platform Price Behavior Rules"), we will provide you with a prominent reminder of upcoming subscription renewals and deduction details at least 5 days in advance, and will provide a simple, easily accessible method to cancel your subscription at any time. You may cancel your subscription through your VideoFrog account settings or by contacting Creem directly in accordance with Creem's terms.
Refund Policy
Except as required by applicable law (including the February 1, 2026 "Measures for the Supervision and Administration of Online Trading Platform Rules") or as explicitly stated herein, all fees paid for credits, subscriptions, or other paid services are non-refundable. Refund requests must be submitted to Creem (our MoR) within 7 days of payment; Creem will review and process refund requests in accordance with its refund policy and applicable law. Refunds will not be provided for: (a) credits that have been used or partially used; (b) subscriptions that have been active for more than 7 days; (c) chargebacks initiated without valid cause (you agree to indemnify us and Creem for any costs, fees, or damages resulting from unauthorized chargebacks); or (d) cases where the Service was used in violation of these Terms. In compliance with regulatory requirements, we reserve the right to provide refunds in cases of service defects, false advertising, or other circumstances where we or Creem are found to be at fault.
MoR Responsibilities
As our MoR, Creem is the legal seller of record for all paid transactions, and assumes full responsibility for: (a) processing payments, including credit card transactions and recurring billing; (b) complying with global tax regulations (including VAT/GST collection and remittance); (c) handling chargebacks, fraud prevention, and payment-related disputes; and (d) ensuring compliance with all applicable financial and data protection laws (including GDPR and CCPA). You acknowledge that Creem may collect and process your payment information (including name, email, billing address, and payment card details) solely to fulfill these responsibilities. We do not store or process your payment card information directly—all payment data is handled by Creem in accordance with its privacy policy and industry security standards (including PCI DSS compliance).
Pricing Changes
We reserve the right to change our prices and billing methods at any time. Any pricing changes will be communicated to you at least 30 days in advance via email or through the Service. If you are on a recurring subscription, the new pricing will apply to your next renewal. Your continued use of the Service after the pricing change takes effect constitutes your acceptance of the new prices. In compliance with regulatory requirements, we will not engage in "big data price discrimination" (i.e., setting different prices for the same service for different users without a reasonable, disclosed reason).
Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without any warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free. We make no warranties regarding Creem's services, including but not limited to the availability, security, or accuracy of Creem's payment processing. Creem's services are provided by Creem on an "AS IS" basis, and we disclaim any liability for Creem's acts or omissions in connection with its payment processing or MoR responsibilities.
Limitation of Liability
To the maximum extent permitted by law, VideoFrog shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill. This limitation of liability applies to all claims arising from or related to the Service, including but not limited to claims related to payment processing, subscriptions, or Creem's acts or omissions as our MoR. We shall not be liable for any damages resulting from: (a) Creem's failure to process payments (Creem shall be solely responsible for such damages); (b) chargebacks or fraud; (c) changes to Creem's terms or services; or (d) any other acts or omissions of Creem. Nothing in these Terms shall limit or exclude our liability for fraud, willful misconduct, or gross negligence, or any other liability that cannot be limited under applicable law.
Changes to Terms
We reserve the right to modify these Terms at any time. Modified terms will become effective upon posting to the website. Your continued use of the Service after changes constitutes your acceptance of the modified Terms. If we make material changes to the terms related to Creem (including payment, subscription, or MoR terms), we will notify you via email at least 30 days in advance. In compliance with applicable regulations, any changes to these Terms that materially reduce your rights or increase your obligations will be communicated in a prominent manner and will not apply retroactively.
